Summary:
Civilian deaths in custody; report.
Requiresevery law-enforcement agency and correctional facility to reportto the Department of Criminal Justice Services certain informationregarding the death of any person who is detained, under arrest orin the process of being arrested, en route to be incarcerated, incarcerated,or otherwise in the custody of such law-enforcement agency or correctionalfacility. The bill provides that any law-enforcement agency or correctionalfacility that fails to comply may, at the discretion of the Department,be declared ineligible for state grants or funds. The bill also requires the Department to analyze the submitted data to (i) determinethe means by which such information can be used to reduce the numberof such deaths and (ii) examine the relationship, if any, betweenthe number of such deaths and the actions of management of such law-enforcementagencies and correctional facilities. Finally, the bill requires the Director of the Department to annually report the findings and recommendationsresulting from the analysis and interpretation of the data to theGovernor, the General Assembly, and the Attorney General beginningon or before July 1, 2024, and each July 1 thereafter.

Photo speed monitoring devices; locality-designatedhighway segments.
Authorizes any locality to authorize, by ordinance,its local law-enforcement agency to place and operate photo speedmonitoring devices in certain locations named in the ordinance, providedthat (i) the highway has a posted speed limit of 35 miles per houror greater; (ii) the ordinance identifies the locality-designatedspeeding offense to be enforced by the photo speed monitoring device;(iii) speeding, crash, or fatality data supports the need for strongerenforcement against speeding; and (iv) in counties and towns whose roads are subject to the control and jurisdiction of the Departmentof Transportation, the locality-designated highway segment is inthe secondary state highway system. The bill directs the localityto also identify the speeding violations that may be enforced byphoto speed monitoring device. Current law authorizes the use ofphoto speed monitoring devices in highway work zones and school crossingzones.

Mandatory reporting of all offenders releasedfrom a local correctional facility or state correctional facilitybefore the completion of the offender's sentence.
Requires theDepartment of Corrections and all local correctional facilities toprovide the Virginia State Crime Commission with the name, last knownaddress, criminal history information, length of sentence incarcerated,reason for early release, and remaining time on such length of sentencefor each offender in the custody of the Department or such local correctional facility. The bill requires the Commission to publishthe names of such offenders along with the reason for early release on its website and provide an annual report by November 15 to theGeneral Assembly concerning the release of such offenders and anyfuture criminal charges and convictions for such offenders.

The bill also requires the Directorof the Department of Corrections to have a defined policy and procedurefor the process of transitioning an incarcerated person placed inrestorative housing out of such housing and back to the general populationof the facility.
