Summary:
Flood Relief Fund established.
Establishesthe Flood Relief Fund (the Fund), funded by reducing the allocationof Regional Greenhouse Gas Initiative (RGGI) funds to the CommunityFlood Preparedness Fund from 45 to 40 percent and allocating the fivepercent to the Fund. The Flood Relief Fund is administered by theVirginia Department of Emergency Management (VDEM) and used to makepayments to owners of property that is damaged by a flood, landslide,or mudslide for which the President declares a major disaster underthe federal Stafford Act. Under the bill, claims are paid at 175 percentof property value in a double distressed locality, 150 percent ofproperty value in a distressed locality, and 100 percent of propertyvalue in all other localities. Claims are limited to $1 million forcommercial properties and $500,000 for residential properties andare exempt from individual and corporate income tax. If there areno flood disasters, VDEM will award grants for flood prevention effortsto applicants in double distressed localities. The bill provides thatif Virginia withdraws from RGGI, $50 million of any unobligated auctionproceeds will be reallocated to the Fund from the accounts establishedfor flood preparedness and low-income energy efficiency programs.

Establishes the VirginiaBlack, Indigenous, and People of Color Historic Preservation Fundfor the purpose of awarding grants to eligible state-recognized andfederally recognized Indian tribes, private nonprofit organizations,and localities for the eligible costs of acquiring land or permanentprotective interest therein, and of undertaking preservation activitieson such land, that is of cultural or historic significance to Black,indigenous, or people of color communities. The bill provides thatland or interests acquired with grant funds shall grant the Boardof Historic Resources or other holder a perpetual preservation interestin the property. This bill is identical to SB 158.

Implements recommendations from the first Virginia Coastal Resilience Master Plan. The bill provides guidelines for the development of a Virginia Flood Protection Master Plan for the Commonwealth and requires that the Coastal Resilience Master Plan be updated by December 31, 2022, and every five years thereafter. The bill establishes the Virginia Coastal Resilience Technical Advisory Committee to assist with the updates and requires the development of a community outreach and engagement plan to ensure meaningful involvement by affected and vulnerable community residents. The bill also requires that the Chief Resilience Officer report every two years, beginning July 1, 2023, on the status of flood resilience in the Commonwealth. This bill is identical to SB 551.

Allows procurement of a roof replacement as part of a larger energy conservation or operational efficiency measure if such replacement is either necessary for the installation of such measure or if the contracting entity determines that the replacement of more. The bill requires any roof replacements not included in the original contract to be publicly noticed on the Department of General Services' central electronic procurement website. Such procurement shall be designed by a licensed architect or professional engineer. Current law prohibits the inclusion of a roof replacement project as part of an energy performance-based contract. This bill is identical to SB 13.

Provides that the State Air Pollution Control Board may promulgate regulations in accordance with an Advanced Clean Car I Program beginning with vehicle model year 2030. Current law requires the Board to adopt such regulations beginning with vehicle model year 2025. Any regulations adopted by the Board under prior law shall be withdrawn and repromulgated.
